# 05 · Insurer rules: DRP guidelines, estimate and supplement rules, non-Northeast state laws Research date: 2026-10-17. Scope extends `research/vive/3-insurers/state_rules.csv` (Northeast) and `docs/03-claims-rulebooks.md`. It does not repeat them. Note on `research/competitive-landscape/evidence/pages/etximpaxt.json`: this file is the eTX ImpaXt marketing page. It has no DRP agreement text. The only DRP line is "A DRP partner needs a supplement. An adjuster wants photos resent." So this report is the first in the folder with primary DRP document text. Note on method: the shared web-search budget ran out near the end of this task. Some leads (court exhibits for GEICO ARX and Allstate GHRN agreements, Utah HB 119 text) were not checked. They are marked UNVERIFIED. ## 1. Notes on insurer documents, with verbatim quotes ### 2.1 Progressive: the one public DRP exhibit (high value) Progressive publishes Exhibit A of its Repair Shop Program Agreement. The agreement body is not public. Progressive can change Exhibit A "upon thirty days' prior written or electronic notice". - Estimate is not a blueprint: "The Estimate is not a 'blueprint' or technical specification mandating how the actual repairs shall be made, as such repairs are the responsibility of the Contractor." - Supplement timing (PDF): "This event should be entered as soon as possible, not to exceed 48 hours after 'At Shop.'" and "Repair Shop must specify in the notes the reason for requesting the Supplement." - The web version (`/vendorconduct/repair-standards/`) puts this rule under "All Shops". - Teardown: "The Contractor may, within forty-eight (48) hours after the vehicle arrives at the Repair Shop, perform minor disassembly (i.e. 'tear down')". - Hidden damage: the shop must "Immediately contact Progressive via Web Tracker" and may continue repairs, but must "Agree to immediately discontinue repairs if requested to do so by Progressive." - Parts: where the estimate specifies an OEM part, the shop "Will NOT substitute such non-OEM part or repair, rather than replace, the existing part, without Progressive's prior written consent." - Payment cap: "Progressive is not obligated to pay any Charges that are: Not part of any Estimate, Supplement or Final Estimate; Not agreed to by Progressive". - Pricing: final charges "will equal the total amount shown on the Estimate, including any Supplements or revisions made or approved in writing by Progressive." No storage charges unless agreed in writing. - Service parity: shops give Progressive service "equal to or exceeds the level of service that is provided to any other insurance carrier(s)". - What it does not contain: no labor rate, no parts-age rule, no aftermarket or recycled quota, no photo list, no scan or calibration rule. Those live in the agreement body or local pricing, which are not public. ### 2.2 State Farm - Supplement form (2025 PDF): request types are "Parts Price", "Labor Time Change", "Repair/Replace Change", "Damage Not on Original", "Other". "The max number of entry boxes should be 5". Files: "PDF, JPG and JPEG", "Each file cannot exceed 17MB", "Total size of uploaded files cannot exceed 19MB", "Maximum of 20 files can be attached". Uploaded files "will become a permanent part of the claim". - Photo guide (2022 PDF): "The number of photos required is dependent on what's necessary to capture and support damage as specified on the estimate or supplement." Required list: "Four overall photos, one from each corner ... with a legible license plate", "Photo of the VIN plate", "Photo of the odometer", "Point of impact photo taken from the height of the damage", "Photos of component damage to support the repair estimate", "Photos of prior damage if present", "Parts removed from the vehicle if partially disassembled", tow and sublet invoices. For supplements: "Overall photo showing current repair status" and "Images to clearly support supplemental items/labor requested". - The portal says: "Only supplements should be submitted via the B2B site." - Labor rates: the B2B FAQ says repairer survey data is what "State Farm considers ... when determining prevailing competitive prices for the local repair market." The survey and the "Market pricing" page need a login. - Parts (2023 memo, as quoted by RDN): "Non-OEM crash parts included on estimates prepared by State Farm or a Select Service® repairer will be certified". Parts with an OEM name or logo "cannot be replaced with aftermarket parts". - Calibration (2025 email, as quoted by RDN): "Repair facilities will incur a $3 charge per VIN when an estimate is run through ADAS MAP" and "This operating expense should not be passed on to State Farm or our customers." Calibration billing "should not exceed the price State Farm would have paid". - The Opus agreement that shops sign says the tool "must not be relied on as an alternative to your own professional skill and judgement" and shops repair "entirely at your own risk". - 2015 Select Service agreement (Pulera exhibit, via RDN 2018): shop must not charge State Farm above "[l]abor rates and paint and materials pricing offered to or agreed to with any other insurer". This is old. Current text is UNVERIFIED. - Appraisal clause: SCRS chair Michael Bradshaw said in April 2026 that "State Farm has intentionally written the appraisal clause language out of policies in states where it's not a regulatory requirement". An Ohio shop owner said Ohio is one such state. UNVERIFIED against filed policy forms (check SERFF). - A 2026 vendor article (RocketPros) says Select Service is CCC-only in 2026. This conflicts with the Sept 2025 dual-platform notice. The article itself says "Limited recent source material was available". Do not use it. ### 2.3 GEICO - Public pages describe only the consumer promise: "GEICO and the repair facility guarantee the repairs for as long as you own your vehicle." No parts or procedure rules. - Calibration table (2024 email, via RDN): "GEICO shops using the asTech Rules Engine will be eligible for an OEM or OEM-compatible scan". The table "may not be all-inclusive and all items are considered for negotiation". GEICO said pricing should be "consistent with prevailing competitive market prices". - Dollar amounts in the GEICO table are not public. UNVERIFIED. ### 2.4 Allstate, USAA, Liberty/Safeco, Farmers, Nationwide, Travelers - None publish DRP guidelines or estimate requirements that we found. - Allstate GHRN staff job posts say consultants review vendor estimates in CCC ONE for "adherence to estimating best practices". This shows an internal rulebook exists. Its text is not public. - A NJ court opinion (BER-L-1784-20, 2022) says Allstate estimates and supplements use the labor rates paid to its network shops. Source: https://www.njcourts.gov/system/files/court-opinions/2022/BER-L-1784-20.pdf. Read via search summary only. UNVERIFIED in full text. - Hartford (2016) told DRP shops to consider same-series recycled parts older than the vehicle. Source: https://www.repairerdrivennews.com/2016/12/07/hartford-changes-policy-will-put-recycled-parts-older-than-vehicle-on-drp-customers-car/. Old, but it is the only public parts-age rule found. - Parts-age rules (for example "OEM for vehicles under 2 years") for the top 9 insurers: not found in any public source. UNVERIFIED. Do not guess. ### 2.5 Supplement rules: what is public | Insurer | Channel | Timing rule | Documents and photos | Source | |---|---|---|---|---| | Progressive | WebTracker "Supplement Request" event | Within 48 h of "At Shop". Reinspection "promptly" | Reason in notes. Shop may continue repairs after notice | Progressive PDF and repair-standards page | | State Farm | B2B Request Supplement form, no login needed | No deadline stated | Itemized supplement estimate, photos, invoices. Photo checklist above | State Farm PDFs | | GEICO | B2B portal (ARX). Fax or email accepted for non-ARX (2016) | Not stated | Not stated | RDN 2016 | | Others | Not public | Not public | Not public | None | State law adds deadlines in some states. See section 3 and the Northeast file (for example NY 2-business-day supplement reinspection). ## 3. State laws outside the Northeast ### 3.1 What changed in 2024-2026 (outside the Northeast) | Date | State | Change | Status | |---|---|---|---| | 2025-09-01 (policies from 2026-01-01) | TX | SB 458: appraisal provision mandatory in personal auto policies | Law. TDI rules proposed Apr 2026, hearing 2026-06-02, adoption UNVERIFIED | | 2025-07-27 (policies from 2026-01-01) | WA | SB 5721: appraisal provision mandatory for first-party physical damage | Law | | 2026-10-18 | WA | R 2025-05 (WSR 26-17-089) rewrites WAC 284-30-330/-370/-380/-390. No photo-only evaluation as a condition of coverage. In-person inspection within 5 business days after a disputed virtual inspection. Written answer to supplements within 5 business days. Labor-rate database source must be disclosed on request. The old "hourly rate alone is arbitrary" clause is removed | Takes effect tomorrow. Verified on the WAC page | | 2027-07-01 | IL | HB 4160 (Public Act 104-0767): statutory right to appraisal, new 215 ILCS 5/398 | Signed 2026-08-07 | | 2027-01-01 | CA | SB 988 Motor Vehicle Glass Act: ADAS calibration disclosure for glass, anti-coercion | Signed Sept 2026 | | 2026 session | GA | HB 1117 and HB 1420: OEM procedures, written itemized denials, supplement deadlines (1 / 3 / 10 business days) | Filed. Passage not found. UNVERIFIED | | 2025 session | TX | SB 1429: OEM parts and procedures for vehicles 36 months old or less | Died in committee | | Dec 2025 | OH | HB 636: aftermarket disclosure and OEM-parts coverage offer | Introduced. Status UNVERIFIED | | May 2026 | OR | Proposed DFR bulletin on virtual claims: in-person adjuster on request, lowball first offers an unfair practice | Proposed. Final status UNVERIFIED | | 2025-05 | CA | CDI made Allstate correct its 2025 labor-rate survey cover letter | Enforcement action | Key result: none of the 12 states has an enacted law that makes insurers pay for OEM procedures, scans or calibrations. The 2024-2026 trend is mandatory appraisal (TX, WA, IL) and limits on photo-only estimating (WA, OR proposal). ### 3.2 Verbatim quotes, state law - WA WAC 284-30-390 (eff. 2026-10-18): "Insurers shall not require the claimant to agree to only photo-based evaluation of damage as a condition of coverage." - WA WAC 284-30-390 (eff. 2026-10-18): insurers "must respond in writing to the claimant and claimant's repair facility with its determination of amounts covered ... within five business days of insurer's receipt of any supplemental damage estimates and final invoice." - WA history note: "WSR 26-17-089 (Matter R 2025-05), s 284-30-390, filed 8/18/26, effective 10/18/26". - CA 10 CCR 2695.81(c): a standard survey "shall result in a rebuttable presumption by the Commissioner that the insurer has attempted in good faith". - CA 10 CCR 2695.81(d)(1)(B)(1): "Only a survey that uses no labor rate information older than sixteen (16) months shall qualify". - CA Ins. Code 758.5 notice: "WE ARE PROHIBITED BY LAW FROM REQUIRING THAT REPAIRS BE DONE AT A SPECIFIC AUTOMOTIVE REPAIR DEALER." - TX Ins. Code 1813.003(b) (SB 458): appraisal is "solely to determine the amount of loss when that amount is in dispute between the policyholder and the insurer". - TDI bulletin B-0031-10: "a claimant has the right to select where a motor vehicle is repaired and the parts used for repairs." - NC G.S. 58-3-180(a): "A policy covering damage to a motor vehicle shall allow the claimant to select the repair service or source for the repair of the damage." - NC 11 NCAC 04 .0419(c)(2): "An insurer shall perform a physical or digital inspection of the damaged vehicle within 10 business days of receipt of the claim." - OR ORS 746.287: "Without the consent of the owner of the vehicle, an insurer may not require, directly or indirectly," a non-certified aftermarket crash part. - CO DOI (2018): "There are no insurance laws under Title 10 that require insurers to follow the manufacturer guidelines on vehicle repair". Quotes for CA, TX, NC, OR and CO come from research agents that read the primary pages. The WA quotes were checked again on 2026-10-17. ### 3.3 Gaps (UNVERIFIED) - Final status of GA HB 1117 and HB 1420, OH HB 636, IL HB 4373 and the TX appraisal rules. - NC bills: ncleg.gov blocked access. IL and OH legislature sites refused connections, so FindLaw and Cornell LII copies were used. - Shop-as-negotiator licensing: only Oregon has a regulator letter (2019, informal) that says a shop may need an adjuster license. The other 11 states have no clear source. - Florida 2024-2026 appraisal changes for auto were not fully checked. - Utah HB 119 (2026, aftermarket notice) appears in a shop blog only. It is outside scope and UNVERIFIED. ### 3.4 State table The full table is also in `05-state-rules-extra.csv` (99 rows, same columns as `state_rules.csv`). | state | topic | rule summary | citation | effective date | source URL | |---|---|---|---|---|---| | CA | labor_rate_rule | A labor rate survey done by the standard method gives the insurer a rebuttable presumption of good faith. The survey must go to all BAR-registered body shops and use only direct shop responses. Data older than 16 months does not qualify. A filed survey qualifies for 1 year. | 10 CCR 2695.81 | Operative 2017-01-01. No later amendment in history notes. No 2024-2026 rulemaking found. | https://www.law.cornell.edu/regulations/california/10-CCR-2695.81 | | CA | labor_rate_rule | CDI enforcement 2025: Allstate's 2025 survey cover letter cited 2695.81(d)(1)(C) incorrectly. If the claimant shows a higher shop estimate, the insurer must pay the difference, name a shop that will repair for its amount, or adjust the shop estimate line by line. No statute makes insurers pay OEM procedures, scans or calibrations. | 10 CCR 2695.8(f)(1)-(3) | Text last amended 2017-01-01; non-substantive change filed 2021-07-14 | https://www.law.cornell.edu/regulations/california/10-CCR-2695.8 | | CA | aftermarket_parts | An insurer can specify non-OEM crash parts only if they equal OEM in kind, quality, safety, fit and performance. How Revv uses this - **Insurer rule packs.** Build a pack for Progressive (48 h supplement, written consent for parts swaps, Mitchell export) and for State Farm (supplement form limits, photo checklist, CAPA/NSF parts, ADAS MAP cap). Other carriers: learn from outcomes, because their rules are not public. - **Supplement packet generator.** Use the State Farm photo list as the default. It is the only insurer photo standard that is public. - **Calibrations on the first estimate.** CCC says 51.5% of calibrations arrive on a supplement. Revv can move them to the first estimate with OEM documents. This shortens cycle time, which DRP scorecards measure. - **State escalation ladder.** Add the 12 new states. The strongest levers: WA 5-day supplement answer and photo-only ban, NC 10-day inspection and shop choice, CA 10-day payment and labor-rate survey rules, TX and WA mandatory appraisal. - **Do not claim** that any of the 12 states forces insurers to pay for OEM procedures. None does. - **Labor rates.** Track paid rates by insurer and market. In WA (from 2026-10-18) and CO (prevailing competitive price), a shop can ask the insurer for the basis of the rate.
